Shein texts class action lawsuit overview: 

  • Who: Amanda Ramirez filed a class action lawsuit against Shein US Services LLC. 
  • Why: Ramirez claims Shein sends unsolicited text messages to consumers and refuses to stop doing so after a request to opt out is made, in an alleged violation of the Florida Telephone Solicitation Act and Telephone Consumer Protection Act. 
  • Where: The class action lawsuit was filed in Florida federal court. 

Online retailer Shein engages in unsolicited text messaging and continues to text consumers who have tried to opt out of the solicitations, a new class action lawsuit claims. 

Plaintiff Amanda Ramirez’s class action lawsuit alleges that Shein refused to honor her request to opt out of receiving its text message solicitations, which she argues violate the federal Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA).  

Ramirez argues Shein does not maintain a list of individuals who opted out of receiving the text messages, does not train its telemarketers and does not maintain a standalone do-not-call list, as allegedly required by law. 

“Defendant’s refusal to honor Plaintiff’s opt-out requests demonstrates that Defendant has not instituted procedures for maintaining a list of persons who request not to receive text messages from Defendant,” the Shein class action says. 

Shein also unnecessarily uses a platform that allows it to send messages automatically without human involvement and without the consent of consumers, the Shein class action alleges. 

Consumer behind Shein class action seeks statutory damages

Ramirez seeks to represent a nationwide class of consumers who have received two or more text messages from Shein regarding its goods and services during any 12-month period after attempting to opt out of receiving them. 

The plaintiff also wants to represent a class of Florida residents who, since July 1, 2021, have received one or more text messages from Shein regarding its goods and services more than 15 days after attempting to opt out of receiving them. 

An additional class is proposed for Florida residents who received the text messages from an autodialer platform during the same time period and under the same conditions. 

The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for herself and all class members. 

A consumer filed a separate class action lawsuit against Shein earlier this year over claims it systematically infringes on digital copyrights of small artists and designers when making its products.

    But I’m in missouri and have a full inbox from shein continuing send text advertisement sales promotion after not only did I request submit option to opt out, but even went as far as demanding all my data be erased, they claimed to have done so but still receiving a harassing overwhelming amount of text through email and what’s app which I’ve never provided them w my info or used WhatsApp with shein. I need added.
