
Penske robocalls class action lawsuit overview:

Rental company Penske Truck Leasing contacts consumers with robocalls without first obtaining the required express written consent to do so, a new class action lawsuit alleges.
Plaintiff Sergio Cabral claims robocalls sent by Penske have “resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.”
“Defendant’s unsolicited prerecorded messages caused Plaintiff harm, including intrusive invasion of privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the Penske class action states.
Cabral wants to represent a nationwide class of consumers who have received an artificial or prerecorded voice message call from Penske regarding its goods or services within the past four years.
Penske in violation of the Telephone Consumer Protection Act, class action claims
Cabral claims Penske is violating the Telephone Consumer Protection Act (TCPA) by sending robocalls that use an artificial or pre-recorded voice, without first obtaining the required express written consent to do so.
“Defendant did not have prior express written consent to call the cell phones of Plaintiff and the other members of the putative Class when its calls were made and/or failed to honor opt-out requests regarding its prerecorded solicitations,” the Penske class action states.
Plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual, statutory, and treble damages for himself and all class members.
A number of class action lawsuits involving claims companies violated the TCPA by allegedly contacting consumers with telemarketing calls or texts without consent have already been filed or resolved this year.
Some of the companies targeted by those complaints were accused of placing the telemarketing calls to numbers listed on the National Do Not Call Registry.
