Medical Waste Junk Fax Class Action Settlement

Medical Waste Services has agreed to pay $250,000 to resolve claims that they sent unsolicited junk faxes advertising their services.

The settlement benefits individuals who received an unsolicited fax from Medical Waste Services between Feb. 25, 2015 and Feb. 11, 2020 who either a) did not give prior express consent and did not have an established business relationship or b) received a fax that did not display a clear opt out option.

Plaintiffs Associated Management Services Inc. and Charles D. Fuszner DMD PC filed their junk fax class action lawsuit in February 2019. The plaintiffs claimed that Medical Waste Services LLC sent them junk faxes advertising their services. The faxes were allegedly sent without recipient consent.

According to the plaintiffs, these faxes violated the Telephone Consumer Protection Act or TCPA. Although the TCPA is often applied to robocalls or spam texts, the law also prohibits unsolicited junk faxes.

Medical Waste Services has not admitted to any wrongdoing but has agreed to resolve the claims against them for $250,000.

Under the settlement, eligible Class Members can collect a $60 cash payment. The settlement will also provide incentive awards of $10,000 and $5,000 for the named plaintiffs.

In order to benefit from the settlement, Class Members must file a valid claim form by June 5, 2020. The deadline for exclusion and objection is April 26, 2020. The final approval hearing for the settlement is scheduled for May 6, 2020.

Who’s Eligible

Individuals who received an unsolicited fax message from Medical Waste Services between Feb. 25, 2015 and Feb. 11, 2020 who either:

1. did not give prior express consent and did not have an established business relationship; OR
2. received a fax that did not display a clear opt out option.

Potential Award

$60 cash payment.
