A North Dakota man has hit Kohl’s with a class action lawsuit alleging the national department store chain violated state and federal laws by bombarding him and others with unauthorized robocalls.
Plaintiff Joshua Johnston filed the class action complaint against Kohl’s Inc on Dec. 26 in a Wisconsin federal court, alleging violations of the Telephone Consumer Protection Act.
Johnston alleges Kohl’s engaged in “aggressive and unlawful” debt collection practices after his store credit card fell into delinquency in July 2024.
He claims he received at least 30 pre-recorded voicemail messages urging him to contact Kohl’s about his overdue account, despite explicitly asking the retailer to stop.
Johnston described the voicemails as “monotone,” stating they lacked personalization and were clearly automated. One voicemail repeatedly said, “Please call Kohl’s Department Store at 1-855-219-9472.”
“The primary purpose of the TCPA was to protect individuals from the harassment, invasion of privacy, inconvenience, nuisance, and other harms associated with unsolicited, automated calls,” the lawsuit says.
The complaint also alleges the calls disrupted Johnston’s daily life, causing mental anguish, annoyance, and even battery depletion from repeated phone use.
Kohl’s robocalls continued after warning, lawsuit alleges
Johnston says the retailer’s failure to halt its robocall campaign, even after being told to stop, forced him to sue.
He is now seeking to represent a nationwide class of people who received similar Kohl’s robocalls or its agents without their consent over the past four years.
He is suing for violations of the Telephone Consumer Protection Act and is seeking certification of the class action, damages, fees, costs and a jury trial.
In October, Kohl’s was hit with a class action lawsuit after a data breach exposed the private information of more than 4 million of its customers.
