A website has been established for a pending class action lawsuit arguing Intero Real Estate Services has violated the Telephone Consumer Protection Act (TCPA) with unsolicited telephone calls.
Although no settlement or judgment has been reached in the case, a website has been established due to the certification of a Class by the court. In July 2020, U.S. District Judge Beth Labson Freeman agreed to certify two Classes of consumers who received calls from Intero despite opting out of such calls via a do-not-call list.
The National DNC Class includes consumers who received one or more telemarketing telephone calls from Interoโs California sales associates within a 12-month period since Sept. 13, 2014, despite their phone number being on the National Do Not Call Registry.
Judge Labson Freeman also certified an Internal DNC Class of similar consumers who, instead of being registered with the National Do Not Call Registry, had their numbers on Interoโs internal do-not-call list after asking the company to not call them.
Consumers can check their eligibility through a phone number lookup tool on the recently established TCPA class action lawsuit website.
Eligible Class Members can also update their information through the websiteโs address update form. This can ensure consumers receive any notice or claim form information in the event a settlement or judgment is reached in the case.

Plaintiff Ronald Chinitz filed his TCPA class action lawsuit in 2018, claiming he and around 69,000 other consumers received unsolicited telemarketing calls from Intero Real Estate Services.
According to Chinitz, the companyโs California sales representatives unlawfully placed these calls despite consumers like Chinitz indicating they would not like to receive them.
Chinitz says he registered his landline and mobile number with the National Do Not Call Registry in July 2017 in order to indicate he did not want to be contacted with telemarketing calls.
In May 2017, Chinitz had listed his California home for sale on an online real estate listing portal called the Multiple Listing Service. According to the plaintiff, this listing clearly indicated he did not wish to be contacted by real estate agents.
Despite this detail and his previous registration with the National Do Not Call Registry, Intero allegedly started to bombard Chinitz with unsolicited telephone calls after his listing expired in November 2017.
Even after Chinitz told the sales representative he did not wish to be contacted, these calls allegedly continued. Although the calls temporarily ceased after the plaintiff spoke with numerous Intero executives, the calls allegedly resumed in 2018.
According to the Intero class action lawsuit, these telephone calls violated the federal TCPA.
With his TCPA class action lawsuit, Chinitz seeks TCPA damages of up to $1,500 for each violation on behalf of himself and the Classes.
