Utility company Oasis Energy recently agreed to pay $7 million to resolve claims that it placed calls with pre-recorded messages, something that is a violation of federal privacy law.

Who is Oasis Energy?

Since 2008, Oasis Energy has provided energy to customers in Illinois, Maryland, Massachusetts, New Jersey, New York, and Pennsylvania. The utility touts its low rates, price stability, and clean energy as reasons to choose Oasis as an energy provider.

“We are an electricity company committed to delivering premium value for you and your home’s electricity needs,” the utility claims on its website. “In addition to supplying electricity and natural gas to residential and business customers, we aim to be a low-cost/high-value provider bringing energy cost savings to our customers in every market we serve.”

However, the utility may bombard consumers with pre-recorded messages and ringless voicemails, according to allegations in a class action lawsuit against Oasis Energy.

Are Pre-Recorded Messages Legal?

Pre-recorded messages, when sent directly to a voicemail, are known as ringless voicemails or voicemail drops. These messages allow companies to send pre-recorded information to a consumer’s voicemail inbox without the phone actually ringing.

According to Stratics Networks, a global provider of voice applications to businesses, there are no laws directly prohibiting the use of ringless voicemails in the United States. However, Stratics notes that the technology must be used responsibly in order to comply with telemarketing laws.

“There are still several rules associated with this and any type of communication method especially if using it for telemarketing or solicitation,” the company states. “Just because Ringless Voicemail Drops fall in a very different area when it comes to regulatory framework, it does not mean the technology can be used irresponsibly.”

Irresponsibly used ringless voicemails and pre-recorded messages may be in violation of the federal Telephone Consumer Protection Act (TCPA), according to legal professionals. Attorneys have taken legal action against companies such as Oasis Energy, alleging that these messages are unlawful if placed without consmers’ express consent.

What Are Your Rights?

Oasis Energy recently agreed to pay $7 million to resolve allegations that the utility violated TCPA with pre-recorded messages. Plaintiff Kenneth A. sued Oasis in 2018, alleging that he and other consumers were besieged with unsolicited pre-recorded messages and ringless voicemails sent from Oasis.

Although the utility agreed to settle the class action lawsuit, Oasis Energy has not admitted to any wrongdoing under TCPA.

The multi-million dollar settlement, which is pending final approval, would benefit individuals who received pre-recorded messages and/or ringless voicemails from Oasis Energy or its affiliates (Censtar, Electricity Maine, Electricity N.H., Major Energy, Perigee, Provider Power Mass, Respond Power, Spark, and Verde) between Feb. 12, 2014, and Sept. 25, 2019.

Class Members who filed a valid claim form by Feb. 20, 2020, may be able to collect a proportional share of the net settlement fund. Exact payment amounts will vary depending on the number of claims filed as well as costs, fees, and other expenses.

    my bank RETURNED the check and chraged me a fee
    anybody know whats up this is bull now i have to pa a RETURNED CHECK CHARGE
