Housecall Pro has agreed to pay $2.2 million to resolve claims that the software company placed unsolicited calls and texts in violation of the Telephone Consumer Protection Act.

The settlement will benefit individuals who received one or more telemarketing calls or texts from Codefied (d/b/a Housecall Pro’s) between March 28, 2015 and Oct. 22, 2019.

Plaintiff Clifford Armstrong filed his class action against Housecall Pro in March 2019. He claimed that the company which provides software services for home service businesses sent him and other consumers unsolicited texts and calls advertising their product. According to Armstrong, these calls and text messages violated the TCPA.

The TCPA is a federal law that requires businesses to have prior express written consent before contacting consumers with telemarketing calls, texts, or faxes. However, having an established business relationship does not exempt companies from this law.

Housecall Pro agreed to resolve the TCPA claims against them by paying $2.2 million. The company does not admit any wrongdoing by settling the allegations against them.

Under the settlement, each Class Member will receive an equal share of the net settlement fund. Payment amounts will depend on the number of claims filed and the net settlement fund amount after expenses are deducted. There are no estimates available at this time.

In order to benefit from the settlement, Class Members need to file a valid Claim Form by Jan. 20, 2020. The deadline for exclusion and objection is Jan. 6, 2020. The final approval hearing for the settlement is scheduled for Feb. 11, 2020.

Who’s Eligible

Individuals who received one or more telemarketing calls or texts from Housecall Pro between March 28, 2015 and Oct. 22, 2019.

Potential Award

Each Class Member who files a valid Claim Form will receive an equal share of the net settlement fund. Exact payments will depend on a variety of factors including the number of claims filed and the amount deducted from the fund for attorneys’ fees, administrative costs, and other expenses.
