Dessert bakery Crumbl sent consumers illegal and unlawful text messages, a new class action lawsuit alleges.
Plaintiff Irving Serra’s class action lawsuit claims Crumbl sent him text messages even after he opted out of receiving them, in violation of the Telephone Consumer Protection Act (TCPA).
“Defendant utilizes aggressive marketing to push its products without regards to consumers’ rights under the TCPA and even after consumers opt out of such marketing,” the Crumbl class action says.
Serra wants to represent a nationwide class of consumers who, within the past four years, were sent a text message from Crumbl after making a request to the company to not receive future text messages.
Crumbl harmed thousands of consumers with unsolicited text messages, class action says
Serra argues Crumbl has harmed thousands of consumers with its aggressive and unsolicited marketing.
“Defendant’s unsolicited text messages caused Plaintiff actual harm, including invasion of his privacy, aggravation, annoyance, intrusion on seclusion, trespass, and conversion,” the Crumbl marketing class action says.
Serra claims Crumbl began sending him telemarketing text messages in August 2024. The messages included opt-out instructions, and Serra says he responded with the word “Stop” in an attempt to opt out of any further texts from Crumbl.
While Crumbl acknowledged Serra’s opt-out request, the company still continued sending him numerous telemarketing text messages, the Crumbl marketing class action alleges.
Serra argues he sent additional “Stop” requests in September, October, November, December and January, but that Crumbl continued to send him unwanted text messages.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of actual and statutory damages for himself and all class members.
Crumbl previously asked a California federal judge last year to throw out claims it allowed a third-party to intercept the personal information and sensitive communications of its website visitors.
