Coach Outlet sends telemarketing text messages at unlawful times, including before 8 a.m. and after 9 p.m., a new class action lawsuit alleges.
Plaintiff Kededra Watler’s class action lawsuit claims the timing of Coach Outlet’s telemarketing texts intruded into the “peace and quiet in a realm that is private and personal” for herself and other consumers.
Watler further argues the timing of Couch Outlet’s telemarketing texts violated the Telephone Consumer Protection Act.
“The TCPA’s implementing regulation … provides in pertinent part that ‘[n]o person or entity shall initiate any telephone solicitation’ to ‘[a]ny residential telephone subscriber before the hour of 8 a.m. or after 9 p.m. (local time at the called party’s location),’” the Coach Outlet class action says.
Watler wants to represent a nationwide class of consumers who, within the last four years and within any 12-month period, received more than one telemarketing text from Coach Outlet or on the company’s behalf initiated before 8 a.m. or after 9.m. in their local time.
Plaintiff never consented to Coach Outlet text messages at odd hours, class action claims
Watler argues she never consented to receiving the Coach Outlet text messages at the hours they were sent.
“Plaintiff never signed any type of authorization permitting or allowing defendant to send them telephone solicitations before 8 a.m. or after 9 p.m.,” the Coach Outlet class action says.
Watler demands a jury trial and requests declaratory and injunctive relief and an award of statutory damages for herself and all class members.
A consumer filed a similar class action lawsuit against Kim Kardashian’s clothing brand Skims Body in December over claims it sent early-morning marketing texts in violation of the TCPA.
