Home Depot and Atlantic Water and Air have agreed to pay $4.35 million to resolve a class action lawsuit alleging the companies placed unwanted telemarketing calls.

The settlement will benefit consumers who received an automated telephone call using a pre-recorded or artificial voice from Home Depot or Atlantic Water and Air between Oct. 16, 2013 and June 1, 2015.

In 2015, plaintiffs Aaron and Evelyn Manopla filed a class action lawsuit against Home Depot and Atlantic Water and Air. When consumers signed up for free water tests, their information was allegedly used to place a barrage of unsolicited sales calls from Home Depot and Atlantic Water and Air.

“Home Depot gave Atlantic Water and Air exclusive access to their stores and their logo with the hope of obtaining consumers information,” the TCPA class action claimed.

According to the plaintiffs, the two companies violated the Telephone Consumer Protection Act (TCPA) by placing their automated phone calls. The TCPA is a federal law that aims to protect consumers from harassing telemarketing calls, texts, and faxes.

Contacting consumers with an automatic dialing system and/or pre-recorded/artificial voice is illegal under the TCPA unless consumers have consented to receiving these communications.

In June 2019, Home Depot and Atlantic Water and Air agreed to settle the claims against them for $4.35 million. Neither company has admitted wrongdoing in the case.

Payments from the settlement will depend on the number of valid claims filed, as each Class Member will receive an equal share of the settlement fund. According to settlement documents, payments are estimated at $110 each and capped at $5,000.

In order to receive payment from the settlement, Class Members need to file a valid Claim Form by Sept. 20, 2019. The deadline for exclusion and objection was Sept. 3, 2019. The final approval hearing for the settlement is scheduled for Sept. 23, 2019.

Who’s Eligible

Consumers who received an automated telephone call using a pre-recorded or artificial voice from Home Depot or Atlantic Water and Air between Oct. 16, 2013 and June 1, 2015.

Potential Award

An equal share of the net settlement fund, up to $5,000 per Class Member. However, estimated payments are $110 each.

    I received $500 and was told I needed to send in the W-9 for the balance. I did mail back the W-9 and haven’t received anything since.

    If you didn’t receive a w9 form, you are not getting any payment, it says so right in the FAQ on the settlement website under “Why did I not receive a w9 form?”.

      It seems like on the ones with the big payouts have gotten their payment so far so they filled out the w9’s. I want to know when the rest of us will be getting our checks.
