Keeler Instruments Fax Ads Class Action Settlement

Keeler Instruments has agreed to pay $310,000 to resolve claims that they violated federal law by sending unsolicited fax advertisements.

The settlement will benefit individuals who received an unwanted fax from Keeler Instruments between Aug. 3, 2014 and July 22, 2019.

Retina Associates Medical Group, the company that served as plaintiff in the class action, filed their complaint in August 2018. The company claimed that Keeler Instruments sent fax advertisements to them and other consumers, thereby violating the Telephone Consumer Protection Act (TCPA).

The TCPA is a federal law that prevents businesses from engaging in harassing telemarketing behaviors without consumer consent. This includes spam text messages, robocalls, unsolicited faxes, and more. Under the TCPA, consumers can file a lawsuit or class action lawsuit and seek up to $1,500 per violation.

According to the TCPA class action, Keeler Instruments violated the federal telemarketing law by sending fax messages without consumer consent and by failing to provide an opt out notice instructing recipients on how to stop the communications.

Keeler Instruments has not admitted any wrongdoing or liability but has agreed to settle the TCPA class action by paying into a $310,000 settlement.

Under the settlement, consumers will be able to recover payments of up to $1,500. The exact payment amount will depend on the number of valid claims submitted. If any settlement fund is left over after payments are made to Class Members, the balance will reportedly be donated to charity.

In order to receive compensation from the settlement, Class Members need to file a valid claim by Oct. 11, 2019. The deadline for exclusion is Sept. 25, 2019. The deadline for objection is Oct. 11, 2019. The settlement’s final approval hearing is scheduled for Dec. 2, 2019.
