A website has been established to inform Class Members of their rights under a Convergent Outsourcing class action settlement.
The Convergence class action settlement will create a $3.71 million dollar fund that will provide benefits to people who claim that they received calls from the collections agency that violated the Telephone Consumer Protection Act.
The settlement website notes that Class Members are those people who received calls from Convergent between November 11, 2016 and February 25, 2019 that fall into two categories:
- a call made to a number that did not belong to the intended recipient for the call
- a call made to a number that Convergent had been instructed not to call
Allegedly, these calls violate the Telephone Consumer Protection Act, which prohibits business from making calls to individuals without their consent for non-emergency reasons.
The Convergent class action settlement goes on to explain that Class Members have a number of options under the settlement.
Class Members can file a claim under the settlement and receive benefits — if they choose this option, they waive their right to pursue independent litigation against the company. The deadline to file a claim is September 23, 2019.
Class Members also have the option to opt out of the settlement deal, which would mean that they will not receive benefits, but would allow them to pursue independent litigation against the company. The deadline to opt out of the settlement is also September 23, 2019.
Class Members also have the option to object to the settlement by September 23, 2019 or attend the final fairness hearing on November 14, 2019.
Class Members who do nothing will not receive benefits from the settlement, but will waive their rights to pursue independent litigation against the company.
The Convergent Outsourcing TCPA violation class action lawsuit was filed by Michael Sheean in May, 2018. He claimed that he received calls intended for his deceased mother, who previously used his phone number.
Additionally, Convergent allegedly also called him to contact someone whom he did not know. He says that he informed the company that he was not the person the company intended to contact, and instructed the company to not place calls to him.
However, the company allegedly continued to place calls to his phone number, though the calls were allegedly not intended for him.
The Convergent TCPA violation class action lawsuit asserts that the company uses an automatic dialing system to predict when the customer will answer the phone and when people will take calls, and predicts when a sales person will be able to take the call.
The TCPA spam calls asserts that these calls violate the Telephone Consumer Protection Act because they are made without the recipients’ consent and are made with automatic telephone dialers, indicating the that the calls are made en masse.
