Optum360 has agreed to pay $6 million to resolve claims that they violated federal law by sending unsolicited fax advertisements.
The settlement will benefit individuals who received a fax message from Optum360 regarding the Optum360 Essentials Coding, Billing, and Compliance Conference on April 15, 2015, May 21, 2015, June 17, 2015, July 23, 2015, Aug. 13, 2015, Sept. 16, 2015, or Oct. 9, 2015.
Plaintiff Steven Conner filed his class action lawsuit against Optum360 in April 2017. Connor argued that the medical coding and billing supply company sent his Steven A. Conner DPM PC office unwanted fax advertisements. These faxes allegedly used up paper, toner, memory, and valuable time.
Conner claimed that the faxes violated the federal Telephone Consumer Protection Act (TCPA). Although most people associate the TCPA with protections from robocalls and spam texts, the federal law also prohibits unsolicited advertisement faxes, sometimes called junk faxes.
Optum360 has agreed to settle the TCPA claims against them with a $6 million settlement. Although the company has agreed to the settlement, they do not admit any liability or wrongdoing.
Under the settlement, Class Members will be able to collect equal payments from the net settlement fund – up to $500.
Exact payments amount will depend on the number of claims filed and the net settlement fund after the deduction of court costs, attorneys’ fees, and incentive awards.
In order to receive payment, Class Members need to submit a valid claim by Oct. 13, 2019. The deadline for exclusion and objection is Sept. 13, 2019. The final approval hearing is scheduled for Nov. 20, 2019.
Who’s Eligible
Individuals who received a fax message from Optum360 regarding the Optum360 Essentials Coding, Billing, and Compliance Conference on April 15, 2015, May 21, 2015, June 17, 2015, July 23, 2015, Aug. 13, 2015, Sept. 16, 2015, or Oct. 9, 2015.
Potential Award
An equal payment of the net settlement fund, up to $500.
Proof of Purchase
Class Members must provide their 10-digit fax number.
