Savers has agreed to settle a class action lawsuit resolving claims that the thrift store violated the Telephone Consumer Protection Act by placing donation solicitation phone calls.

The settlement will benefit all individuals who received calls from Savers regarding making a donation on behalf of the Epilepsy Foundation of America between July 1, 2011 and Sept. 30, 2015.

According to the Savers class action, Savers has a contractual relationship with the Epilepsy Foundation. To solicit donations for the foundation, Savers allegedly made calls to consumers through their subsidiary Apogee Retail LLC.

Plaintiff Sean Hartranft claims that he and other consumers received these calls despite having never consented. In his Savers class action lawsuit, Hartranft alleges that Savers’ unsolicited calls violated the TCPA.

The TCPA is a federal law that protects consumers from harassing telemarketing practices through calls, text messages, and faxes. The act requires businesses to receive prior, written consent before contacting consumers through telemarketing communications. Hartranft claims that Savers failed to secure this consent before contacting consumers.

Under the Savers class action settlement, Class Members can choose to receive either $75 worth of goods from any Savers or Value Village thrift store or they can choose to receive a check for $25. In order to receive either award, Class Members need to submit their valid claim through the mail or online by Aug. 15, 2019.

The deadline for exclusion and objection is July 16, 2019. The final approval hearing is scheduled for Oct. 21, 2019.

Who’s Eligible

Individuals who received calls regarding donation solicitation on behalf of the Epilepsy Foundation of America between July 1, 2011 and Sept. 30, 2015.

Potential Award

$75 in goods at any Savers or Value Village thrift store or $25 in the form of a check

    UPDATE: On October 21, 2019, the Court granted final approval of the Settlement. Class Members who submitted valid claims will be issued a Settlement Certificate. Distribution of Settlement Certificates is expected to occur in December 2019.
