The Susan B. Anthony List has agreed to pay more than $1 million to resolve claims that it violated federal law by sending unsolicited text messages.

The settlement will benefit all individuals in the U.S. who, between July 9, 2018 and Dec. 7, 2018, were sent a text message to their cell phone by Mudshare or a similar service on behalf of Susan B. Anthony List.

In July 2018, plaintiff Shehan Wijesinha filed a class action lawsuit against Susan B. Anthony List Inc., claiming that the organization wrongfully sent unsolicited text messages to him and other consumers.

The non-profit organization allegedly sent 203,486 text messages to Wijesinha and other consumers. Each message allegedly contained political news and a link to Susan B. Anthony List’s YouTube channel.

Wijesinha claims that he never provided express written consent to the Susan B. Anthony List, meaning that they did not have the right to send him telemarketing text messages.

According to the class action lawsuit, these text messages violated the Telephone Consumer Protection Act (TCPA).

The TCPA is a federal law that protects consumers from harassing communications through phone calls, text messages, and faxes. The law allows consumers to take legal action against companies that send them unsolicited communications.

To resolve claims against them, the Susan B. Anthony List has agreed to pay $1,017,430 towards Class Member claims, $141,000 towards administrative costs, $2,500 for plaintiff service award, and $225,000 in attorneys’ fees and costs.

Class Members who file a valid claim by Sept. 19, 2019 will be able to receive a $5 payment for the text message received from Susan B. Anthony List.

The deadline for exclusion and objection is June 19, 2019. The final approval hearing for the settlement is scheduled for Sept. 4, 2019.

Individuals who, between July 9, 2018 and Dec. 7, 2018, were sent a text message to their cell phone by Mudshare or a similar service on behalf of Susan B. Anthony List.
