A $1.2 million class action settlement has been reached, ending claims that Bluestem Brands placed wrong number phone calls to potential Fingerhut, Gettington, or PayCheck Direct consumers in violation of federal law.

Class Members include those who received a call on their cell phone from Bluestem Brands Inc. between Nov. 2, 2015 and July 8, 2018 concerning a balance on a Fingerhut, Gettington, or PayCheck Direct account.

The call must have been made via LiveVox Inc.’s Quick Connect platform and Bluestem’s records must contain a record of a wrong phone number.

Lead plaintiffs alleged in the Fingerhut, Gettington, or PayCheck Direct wrong number class action lawsuit that Bluestem Brands contact consumers without their prior express consent in violation of the Telephone Consumer Protection Act, or TCPA.

According to the complaint, Bluestem is the parent company of 14 different e-commerce brands that sell a variety of products, from bedding to wedding rings.

The class action lawsuit alleged that Bluestem’s records were such that the company failed to acknowledge when they were calling incorrect numbers in connection with customer accounts.

Individuals reportedly received multiple calls from Bluestem despite telling the company that they had the wrong number. The Bluestem class action alleged that the company violated the TCPA.

The TCPA was enacted as a federal law in the 1990s to protect consumers from harassing telemarketers.

Under the TCPA, companies are prohibited from making advertising calls, text messages, and even sending faxes to consumers without prior express permission.

Further, companies are barred from using automatic dialing systems and prerecorded messages, sometimes called robocalls.

Bluestem agreed to pay $1.2 million to end the Fingerhut, Gettington, or PayCheck Direct wrong number class action lawsuit.

Under the terms of the class action settlement, Class Members will receive an equal share of the settlement amount, after attorneys’ fees and expenses and plaintiffs’ awards are deducted.

Bluestem has identified 280,570 Class Members, according to its records.

Class Members must submit a Claim Form online or via mail. The Claim Form must include the cell phone number that received the Fingerhut, Gettington, or PayCheck Direct wrong number call.

Class Members have until July 16, 2019 to opt out of or object to the settlement agreement.

Who’s Eligible

Class Members include those who “received one or more telephone calls to [their] cellular telephone from Bluestem Brands, Inc. from November 2, 2015 through July 8, 2018, that were wrong number calls—in that [they were] not a customer of one of Bluestem’s businesses (Fingerhut, Gettington, or PayCheck Direct).”
