A $5 million settlement will end a Nationwide Mutual Insurance class action lawsuit over claims that the insurer placed unwanted robocalls to consumers without their consent.
Class Members include those who received telemarketing calls regarding Nationwide home or auto insurance without providing prior express consent to receive the calls between Sept. 27, 2012 through Oct. 15, 2018.
The Nationwide class action settlement also benefits consumers who were contacted on behalf of Nationwide by MediaAlpha or Variable advertising companies, as well as those who had their number included on Nationwide’s internal do not call list, but who were contacted anyway.
Lead plaintiffs accused Nationwide Mutual Insurance of contacting thousands of consumers without permission using a prerecorded message, or robocall.
According to the Nationwide class action, Nationwide used third party telemarketing companies to contact consumers and did so in violation of the Telephone Consumer Protection Act.
The TCPA prohibits companies from calling consumers with advertising messages without obtaining their prior express consent. Further, companies are limited from using automatic dialing systems and prerecorded messages to advertise to consumers.
In addition, the TCPA set up internal as well as the national do not call registries that allow consumers to list phone numbers at which they do not want to be contacted by telemarketers. Fines under the TCPA are high, ranging from $500 to $1,500 per violation.
The Nationwide Mutual Insurance robocalls class action lawsuit accused the insurer of failing to pay enough mind to TCPA compliance when contacting consumers.
Nationwide Mutual agreed to pay $5 million to end the class action lawsuit. Under the terms of the settlement agreement, cash awards will be automatically paid to some Class Members, while others will need to make a claim.
Class Members who received a call from Variable Marketing and/or whose telephone call or lead information was transferred to a Nationwide agent will automatically receive a settlement payment of approximately $60.
Class Members who received a call advertising Nationwide’s homeowners or automotive insurance products and/or whose telephone call or lead information was transferred by MediaAlpha to Nationwide will need to make a claim. Claims for MediaAlpha Class Members are estimated to be $30.
Those who were registered with Nationwide’s internal do not call list and received more than one telemarketing call concerning Nationwide products within any 12-month period during the Class period will also need to file a Claim Form to receive payment. Claims for Nationwide do not call list Class Members are estimated to be $75.
Class Members who must file claims will need to provide a Claim ID number or the phone number where they received the Nationwide Mutual Insurance robocall.
The deadline to object to or opt out of the settlement agreement is June 21, 2019.
UPDATE: On Sept. 27, 2019, Top Class Actions viewers started receiving checks from the Nationwide Mutual Insurance robocalls class action settlement worth as much as $55.24. Congratulations to everyone who filed a valid claim and got PAID!
Who’s Eligible
There are three sets of Class Members;
“MediaAlpha Settlement Class: All persons within the United States who received a telephone call advertising Nationwide’s homeowners or automotive insurance products, whose telephone call or Lead Information was transferred by MediaAlpha to Nationwide during the Class Period [Sept. 27, 2012 through Oct. 15, 2018].
Nationwide IDNC Settlement Class: All persons within the United States who (a) received more than one telephone solicitation within any 12-month period falling within the Class Period (b) on their phone number that had been registered on the Nationwide Internal Do Not Call Registry for more than 31 days, (c) the purpose of which was to advertise Nationwide’s automotive or homeowners’ insurance products.
Variable Settlement Class: All persons within the United States who received a telephone call from Variable Marketing, whose telephone call or Lead Information was transferred to a Nationwide Agent during the Class Period.”
Potential Award
$30 to $75 depending on the Class.
Variable Class Members are expected to receive an automatic payment of $60. MediaAlpha Class Members will need to submit a Claim Form in order to receive an estimated $30. The Nationwide IDNC Class will also need to file a claim to receive approximately $75.

I got a check in the mail today for $9.58 in this settlement case. Is this a second disbursement or for people who slipped through the cracks in the initial batch?
