A $5 million class action settlement will resolve allegations that Schumacher Automotive sent text messages to consumers without receiving their written permission to do so.
Class Members include those who received a text message from Schumacher Automotive between July 11, 2014 and Feb. 20, 2019.
Plaintiffs accused the auto dealership of sending unwanted messages to their and other consumers’ mobile phones.
According to the Schumacher text message class action lawsuit, the company failed to obtain prior express written consent from consumers before sending the advertising messages in violation of the Telephone Consumer Protection Act.
The Telephone Consumer Protection Act was enacted to protect the public from overzealous telemarketers. The TCPA extends to text messages sent to mobile phones and requires advertisers to get permission before sending marketing material.
Under the terms of the Schumacher text message class action settlement, Class Members can receive up to $180.
To make a claim, Class Members must submit a Claim Form with the phone number that received the Schumacher text message. Currently, Claim Forms must be printed and mailed.
Class Members who wish to opt out of or object to the class action settlement must do so by May 29, 2019.
Who’s Eligible
“All individuals residing in the United States (i) who were sent a text message (ii) on his or her cellular telephone (iii) by or on behalf of Schumacher Automotive, Inc. (iv) from July 11, 2014 through February 20, 2019.”
