A $19.2 million settlement will resolve a class action lawsuit alleging Universal Pictures sent unwanted text messages promoting the release of the film “Warcraft.”

If you received a text from Legendary Pictures, Universal Pictures, and Handstack advertising “Warcraft” between May 1, 2016 through April 8, 2019, you could get either $35 or $50 from this settlement.

Lead plaintiffs accused the movie makers of impermissibly sending text messages announcing the game-based movie in violation of federal law.

According to the “Warcraft” text messaging class action lawsuit, Legendary Pictures, Universal Pictures, and Handstack, who all had a hand in the making, production, and marketing of the movie, sent text messages to various consumers who had no interested in receiving the advertisements.

The plaintiffs alleged that the movie makers violated a federal law called the Telephone Consumer Protection Act, or TCPA.

Under the TCPA, advertisers are barred from sending unwanted text messages containing marketing information without prior express consent. The TCPA also limits the hours in which telemarketers can send advertising messages.

Additionally, the TCPA created the Do Not Call Registry. Consumers can add their number to the registry and telemarketers are prohibited from contact that number with advertisements.

Consumers contacted include those who gave no prior permission to Legendary Pictures, Universal Pictures, and Handstack to receive the “Warcraft” text messages as well as those whose numbers were included on the Do Not Call Registry.

Additionally, according to the class action lawsuit, a number of consumers received multiple unwanted text messages.

The defendants admit no wrongdoing, but have agreed to pay $19.2 million to end the “Warcraft” text message class action lawsuit.

The settlement agreement consists of four different Classes, including:

  • Those who received unwanted “Warcraft” text messages
  • Those who continued to receive unwanted text messages even after notifying defendants that they did not wish to be contacted further
  • Those who were contacted despite being listed on the Do Not Call Registry
  • Those who received “Warcraft” text messages outside of the permissible hours under the TCPA, or outside of 8 a.m. and 9 p.m. local time

Under the terms of the settlement, Class Members who received unwanted “Warcraft” text messages will receive $35; those who qualify for the other Classes will receive $50.

In addition, the defendants have agreed to modify their marketing policies to avoid sending unwanted text messages.

To make a claim, Class Members must provide their Class Member ID from the settlement notice. Those who did not receive the notice can contact the settlement administrator at 1-833-402-1723.

The deadline to opt out of or object to the “Warcraft” text messages class action settlement is May 16, 2019.

Who’s Eligible

Class Members consist of the following;

  1. “The ‘ATDS Class’ consists of all persons or entities within the United States who received one or more text messages as part of the WarcraftText Messaging Campaign.
  2. The ‘Internal-Do-Not-Call Class’ consists of all persons within the United States who received more than one text message as part of the Warcraft Text Messaging Campaign, one of which was received after the class member submitted a request to not receive additional texts.
  3. The ‘National Do-Not-Call Class’ class consists of all persons within the United States who received more than one text message as part of the Warcraft Text Messaging Campaign (a) in a 12-month period; and (b) more than 30 days after the placement of their number on the National Do-Not-Call Registry.
  4. The ‘Out of Time Class’ class will consist of all persons within the United States who received more than one text message to a residential line as part of the Warcraft Text Messaging Campaign, at least one of which was before 8 A.M. or after 9 P.M. local time at the texted person’s location.”
Potential Award

ATDS Class will receive $35; Internal-Do-Not-Call, National Do-Not-Call, and Out of Time Classes will receive $50.
