A $1.45 million settlement has been reached, ending class action claims that Imprimis Pharmaceuticals sent unwanted fax advertisements in violation of federal law.

If you were sent an advertisement from Imprimis via fax on July 29, 2016, Aug. 31, 2016, Sept. 6, 2016, or Nov. 16, 2016, you could get up to $133.83 per fax from this settlement.

A class action lawsuit accused the pharmacy company of sending faxed marketing materials regarding their topical sinus therapies, liquid unit dose vials, custom prescription pads, and personalized clinical consultants to consumers without their prior express permission.

According to the class action lawsuit, the unwanted Imprimis Pharmaceuticals fax tied up users’ fax machines, wasted time, paper, and ink.

Additionally, the plaintiffs claim the unwanted faxes violated federal consumer protection law — the Telephone Consumer Protection Act.

The Act, also known as the TCPA, was put in place by Congress in 1991 to shield consumers from the onslaught of telemarketers using phones and faxes to inundate consumers. The law also includes unwanted text messages.

According to the Imprimis Pharmaceuticals fax class action lawsuit, doctor’s offices and others were sent advertising via fax in violation of the TCPA.

Imprimis denies any wrongdoing, but has agreed to settle the class action lawsuit by paying $1.45 million.

Class Members must complete either an online Claim Form or print and mail a paper copy. The online Claim Form requires a Claim ID and Pin provided on the settlement notice. The mailed Claim Form must include the Class Member’s fax number.

The deadline for Class Members to exclude themselves from the Imprimis Pharmaceuticals fax class action settlement is June 10, 2019. The deadline to object to the settlement is July 15, 2019.

Class Members include those who were sent Imprimis Pharmaceutical faxes on July 29, 2016, Aug. 31, 2016, Sept. 6, 2016, or Nov. 16, 2016.

    Why should I keep doing top class action settlement Law Firm filling out the papers and once y’all go to court on the only I don’t even receive the check so what department filling out these online these top class action settlement online when I didn’t already did a lot on me I ain’t y’all don’t even want to return the money I hadn’t received a check it out and done a bunch of them from 2014 15 16 17 18 really go back from 2011 I ain’t received none of them so I don’t think I need to just keep on doing them I ain’t get no checks but Linda Willis ain’t getting none of them chicks so where y’all sending my money y’all not send it to 815 Rice Street so where are they going and y’all parking
