Allstate Class Members May Get $450 Each in ‘Spoof’ Call Class Action Lawsuit

Those who received a “spoof” telemarketing call advertising Allstate Insurance may be able to claim as much as $450 in class action rebates, according to settlement documents submitted Friday.  

If approved, the class action settlement will provide rebates to those who received a telemarketing call from or on behalf of Allstate Insurance from leads generated by advertising companies AGAX, Overstep, or Phoenix Leads, between Sept. 23, 2016, and the date the agreement is approved by the court. Approximately 500 Class Members will be able to make a claim by mail or electronically through the settlement website, according to court documents.  

Lead plaintiff, Morgan Carpenter, claimed in her class action lawsuit filed in Ohio federal court that she and other consumers were called by Allstate telemarketers despite registering their numbers on the Do Not Call List – a violation of the Telephone Consumer Protection Act (TCPA). Further, Allstate allegedly hired marketing companies that used “spoof” telephone numbers, or phone numbers that appear to come from the recipient’s home area code on the caller ID in an attempt to trick them into picking up the telemarketing call.   

Carpenter claimed that she had received several such calls, despite registering her number on the Do Not Call List in 2015. The plaintiff alleged that she had to provide a fake name to one of the telemarketers to figure out where the calls originated.  

The plaintiff said that she was able to determine that the calls were a marketing effort for Allstate, which used several telemarketing companies to pepper her and other consumers with unwanted, spoofed calls. 

Court documents seeking preliminary approval of the settlement agreement were submitted Friday. In addition to a proposed $450 class action rebate to each Class Member, Allstate has agreed to pay attorney fees and a plaintiff’s award.  The insurance company will also provide a list of approximately 500 phone numbers that were generated by the marketing companies that allegedly used spoof calls to contact consumers. This list will be used to notify Class Members, according to settlement documents. 

Allstate admits no wrongdoing under the terms of the class action settlement.
