NATIONWIDE TAX CONSULTING AUTO DIALING class action lawsuit

Nationwide Tax Consulting negligently, knowingly, and willfully violates the Telephone Consumer Protection Act (TCPA) by sending consumers robocalls and automated text messages, a new class action lawsuit alleges.

The class action lawsuit was filed in California on June 17 by lead Plaintiff William Loftus who alleges that the company invaded his privacy and broke the law by sending him automated calls and text messages.

Loftus says that Nationwide Tax Consulting started calling him in October 2020 in an effort to sell or solicit its services.

On October 5, Nationwide Tax Consulting placed a call to Loftus’ cellphone and also sent him a text message, the claim states.

“The phone call and text message placed to Plaintiff’s cellular telephone were placed via an ‘automatic telephone dialing system’,” it says.

The class action lawsuit adds that Loftus incurred a fee for the calls placed by Nationwide Tax Consulting.

Loftus, who is not a customer of Nationwide Tax Consulting, had never provided any personal information, including his cellular telephone numbers, to the company for any purpose whatsoever, the claim says.

“In addition, Plaintiff told Defendant at least once to stop contacting them and Plaintiff has been registered on the Do-Not-Call Registry for at least thirty days prior to Defendant contacting him.”

There the company never received Loftus’ “prior express consent” to receive calls using an automatic telephone dialing system or an artificial or prerecorded voice, the class action lawsuit states. In turn, the company violated the TCPA.

Loftus is seeking up to $1,500.00 in damages for each call, which he says did not constitute calls that were for emergency purposes, allowed under the law.

He wants to represent anyone in the U.S. who received an automated phone call or text from Nationwide Tax Consulting, and is seeking damages and a jury trial.

Recently, car dealership Hendrick Honda was hit with a class action lawsuit for allegedly violating the TCPA. Plaintiffs say that the company’s actions resulted in the invasion of privacy, harassment, aggravation, and disruption of the daily life of thousands of individuals.

    I recieve numerous calls texts and voicemail as everytime i recieve a call i block them but they call back with diff number I get calls and voicemails from car dealerships car insurance and lately tax help and one is i don’t even drive lol

    I’m on the DO NOT CALL LIST FOR MANY MANY YEARS
