Physician Compassionate Care, doing business as DocMJ, has agreed to a class action settlement benefiting consumers who may have received text messages from the company.
The nationwide Class includes anyone who was sent a text message by or on behalf of Physician Compassionate Care on their mobile telephone from June 14, 2015, through the date of final approval of the settlement — expected to be June 14, 2021 — using the text messaging platform provided by Twilio to send text messages like the one the plaintiff received.
Each Class Member filing a timely and valid claim form will receive a check for up to $18, less the cost of notice and administration, attorneys’ fees and expenses, and a service award.
Only one claim form may be submitted per Class Member.
Payments are expected to go out only after the Court grants final approval and after any potential appeals are resolved.
The plaintiffs in a class action lawsuit had alleged Physician Compassionate Care violated the Telephone Consumer Protection Act (TCPA) by sending text messages to mobile numbers without the recipients’ prior written consent.
The TCPA was an effort by the federal government to regulate telemarketer solicitation calls, faxes, and texts to consumers.
Physician Compassionate Care has denied all allegations of wrongdoing, and a court has not found in favor of either side in this case.
A final approval hearing is scheduled for June 14, 2021.
Class Members wishing to object to or opt out of the Physician Compassionate Care settlement must do so by May 15, 2021.
Those who wish to be excluded from the settlement must send a letter by mail to the settlement administrator.
The deadline to file a claim is June 29, 2021.
