Yodel Technologies has agreed to pay $1.75 million to benefit consumers who may have received marketing calls without giving their consent.
Included in the Class is anyone in the Red Dot Data marketing list for whom Yodel Technologies’ records reflect a telephone call lasting more than 30 seconds regarding Yodel’s home security systems that was handled by an agent who applied status code 20 or 50 to the call, and that resulted in the normal clearing disposition.
A Subclass also has been approved. The Subclass consists of anyone in the Red Dot Data marketing list for whom Yodel Technologies’ records reflect a telephone call that lasted more than 30 seconds regarding Yodel’s home security systems, was handled by an agent who applied status code 50 to the call, and that resulted in the normal clearing disposition.
Excluded from the Class is anyone whose contact information is associated with either an IP address or website URL in the Red Dot Data marketing list.
The plaintiffs in a class action lawsuit had accused Yodel Technologies and NorthStar Alarm Services of violating the Telephone Consumer Protection Act (TCPA) by placing unsolicited, pre-recorded telemarketing calls to residential phone lines.
The federal TCPA was an effort by the United States government to regulate telemarketing calls made to consumers, both live and through the use of automatic dialing systems. The law now also covers unwanted faxes and text messages.
On June 9, 2020, the Court preliminarily approved a classwide settlement agreement between the plaintiff and NorthStar that would resolve the Class’ claims against NorthStar, but leave the claims against Yodel unaffected, according to the settlement agreement. Between May and September 2020, the parties negotiated to resolve the Class’s claims against Yodel.
While Yodel Technologies denies any allegations of wrongdoing, both parties have agreed to the settlement in order to avoid the risk and expense of continuting litigation.Â
Each Class Member filing a valid claim will receive a proportional share of the amount remaining in the settlement fund after attorneys’ fees and other costs are paid.
It is estimated each Class Member will receive between $100 and $150.
In addition to the monetary relief, Yodel Technologies has agreed to an injunction that prohibits certain conduct when it comes to telemarketing practices.
A final approval hearing is scheduled for June 26, 2021.
Postcard notices were sent to Class Members on Feb. 26, 2021.
Anyone wishing to object to or opt out of the Yodel Technologies settlement must do so by April 27, 2021.
The deadline to file a claim is also April 27, 2021.
