A Washington woman has filed a class action lawsuit against ZoomInfo Technologies LLC over allegations that the company misuses and monetizes the personal information of over 209 million Americans.
The complaint from plaintiff Memary LaRock alleges that ZoomInfo knowingly infringes upon the rights of these individuals, despite the associated legal risks.
ZoomInfo offers a variety of business development products, including access to a vast database of personal information. This database contains names, employment information, email addresses, phone numbers, physical addresses, and other identifying details for millions of working professionals, according to the claim. This information is publicly accessible through the ZoomInfo website and cataloged, making the individual profile pages visible through Google and other search engines.ย
This information was collected and published without obtaining consent or informing impacted parties, the ZoomInfo class action lawsuit alleges.
The company also allegedly used this information to advertise subscription services, monetizing the private details of millions of individuals and potentially violating state law. Washington stateโs Personality Rights Act strictly prohibits companies from using someoneโs name or likeness for advertising purposes without obtaining consent, according to the lawsuit.
ZoomInfo shares private information as part of free trial, lawsuit claims
Part of the marketing implemented by ZoomInfo includes offering two types of free trials: a time-limited trial period and ZoomInfo Lite, according to the lawsuit, which says these programs are strategically designed to attract new subscribers.ย
During the time-limited trial period, users have full access to all of the services and information available through the ZoomInfo website, including accessing contact information, the lawsuit says; at the end of the trial period, the user is encouraged to sign up for a subscription.ย
ZoomInfo Lite is also called the Community Edition. This offers users limited access to millions of profiles.ย
During both types of free trials, ZoomInfo uses the names and personal details of individuals to advertise and upsell its subscription services, the ZoomInfo class action lawsuit claims.ย
This is not the first time ZoomInfo has faced these allegations. In 2021, another woman claimed in a similar class action lawsuit that ZoomInfo had used her personal information in promotional materials.
