Walmart has agreed to pay $10 million to settle claims it violated Illinois privacy law by collecting palm scan data from employees through a cash recycler system without their consent.

The Walmart palm scan class action settlement benefits all current and former Walmart associates who worked at a Walmart store, Supercenter, Neighborhood Market, or Sam’s Club in Illinois and, without providing written consent, used a palm scanner to access the cash recycler system between Jan. 28, 2014, and Feb. 28, 2019, at a Walmart location or between Jan. 28, 2014, and April 24, 2019, at a Sam’s Club location.

After attorneys’ fees and other litigation costs are paid from the settlement fund, each Class Member who submits a valid claim form will receive a portion of the remaining money, according to the settlement agreement.

The plaintiff filed their class action lawsuit in January 2019, claiming Walmart was in violation of the Illinois Biometric Privacy Act (BIPA) because the company required the plaintiff and other employees to use a biometric cash register system.

BIPA requires employers in Illinois to meet certain privacy conditions before they transfer or obtain any biometric information — such as fingerprints, palm scans, retinal scans, and other unique personal data — from employees.

Companies must obtain employees’ written consent before collecting such data, according to the law. They also must provide guidelines for how long they intend to keep the data and for how the data will be destroyed.

Under BIPA, Illinois employers also are barred from leasing, trading, selling or otherwise profiting from their employees’ biometric data.

The class action lawsuit alleged Walmart not only collected employees’ palm scans without obtaining written consent but also failed to have a publicly available schedule for data retention and destruction.

Walmart filed a motion to dismiss the palm scan class action lawsuit. During the process of making motions and filing responses, Walmart denied the plaintiff’s allegations and argued employees were able to access the cash recycler system with either a palm scan or numerical PIN. Walmart also said it did not have documentation of which employees accessed the system using a palm scan rather than a PIN.

The parties agreed in April 2020 to explore a potential settlement, which they finally reached in November 2020.

Walmart denies any liability but has agreed to the settlement to end the litigation.

A final approval hearing is set for June 16, 2021.

The deadline to submit a claim, request to be excluded, or object to the Walmart employee palm scan class action settlement is May 2, 2021.

Who’s Eligible

All current and former Walmart associates who worked at a Walmart store, Supercenter, Neighborhood Market, or Sam’s Club in Illinois and, without providing written consent, used a palm scanner to access the cash recycler system between Jan. 28, 2014, and Feb. 28, 2019, at a Walmart location or between Jan. 28, 2014, and April 24, 2019, at a Sam’s Club location.

No proof of purchase is required, but claimants will be asked to provide the claim number and PIN on the claim form they received via mail or email. If you do not have this information, contact the settlement administrator.
