Superior Health Linens has agreed to pay $790,000 to settle claims it violated the Illinois Biometric Privacy Act (BIPA).
Class Members who can benefit from this settlement are current or former Superior Health Linens employees who used a hand scanner time clock at an Illinois facility between Feb. 28, 2019, and Jan. 12, 2021.
Each Class Member is expected to receive approximately $620.
Under the terms of the settlement, Superior Health Linens also has agreed to comply with BIPA in the future.
The plaintiff in a class action lawsuit alleged Superior Health Linens violated BIPA by requiring employees to clock in and out using a hand-scanning time clock without complying with the law’s requirements.
Under BIPA, employers are not permitted to collect, store, or give out employees’ biometric data — information such as face or fingerprint scans — without providing notice, getting consent from the employee, and making public a policy about how the data is used and how long it will be kept.
Superior Health Linens provides linens and similar textiles to the Midwest’s health care industry.
According to the class action complaint, when employees are onboarding at Superior Health Linens, they are required to scan their handprint so they can use the time clock.
However, the plaintiff claims, Superior Health Linens violates BIPA by not informing the plaintiff or Class Members in writing of the purpose for which their handprints were being collected, nor for how long the data would be stored and used. The company also allegedly did not provide employees with a retention schedule for permanent deletion of the data, nor did it obtain written consent from the plaintiff or Class Members.
Superior Health Linens denies any wrongdoing, but has agreed to the settlement in order to avoid the time and expense of continued litigation.
The settlement administrator will send a check to Class Members’ last known address. Addresses can be updated on the settlement website.
Class Members are advised to complete the W-9 form on the website, either electronically or via downloaded form, and mail it to Lopez-McNear v. SHL, c/o Settlement Administrator P.O. Box 292 Warminster, PA 18974-0292. This will help avoid a backup tax withholding.
You will still be able to receive a payment if you do not fill out the W-9, but taxes will be withheld from the check.
No claim form is needed to benefit from this settlement.
The deadline to object to or exclude yourself from the settlement is April 6, 2021.
A final hearing is scheduled for April 27, 2021.
