Sunshine and Life Health Advisors has agreed to pay a $2.556 million settlement to end claims the insurance company violated the Florida Telephone Solicitation Act (FTSA) by sending marketing texts without the recipients’ consent. 

Class members include all individuals sent a text message regarding Sunshine and Life Health Advisors’ goods or services from or on behalf of the company on or after July 1, 2021.

Luis Alejandro Alvarez filed the Sunshine and Life Health Advisors FTSA class action lawsuit, claiming the company sent him marketing texts even though he did not consent to receive these text messages. He states this violated his rights under the Florida Telephone Solicitation Act, which requires companies to seek an individual’s prior, express, written consent before sending them marketing text messages. 

According to Alvarez, he was injured by these text messages because they intruded on his time, caused him frustration and caused him to spend his time and usage of his phone on the marketing texts. 

Alvarez filed a class action lawsuit against Sunshine and Life Health Advisors because, he states, many other individuals received similar messages without their consent. 

Sunshine and Life Health Advisors does not admit wrongdoing in response to Alvarez’s accusations but has agreed to settle the claims in the interest of avoiding the continued costs and risks of litigation.

Of the $2.556 million marketing texts settlement fund, up to 20% has been allocated for attorney fees and costs, while $5,000 has been designated for Alvarez as a Class Representative award. 

Class members will be eligible for payments from the remainder of the settlement.

Class members who submit a valid claim for benefits will be sent a $300 check within 60 days. 

The deadline to object to or be excluded from the settlement was Oct. 15, 2022.

A final approval hearing took place Nov. 4, 2022.

The deadline to file a claim in the Sunshine and Life Health Advisors marketing texts settlement is Nov. 19, 2022.
