Redfin data privacy class action lawsuit overview:

Real estate company Redfin tracks the video viewing activity of its website users and shares that and other sensitive data with its third-party code vendors, all without consent, a new class action lawsuit alleges.
Plaintiff Guillermo Mata’s class action lawsuit claims Redfin failed to get valid consent from its users prior to using third-party code to track and share their personally identifiable information (PII) and the pre-recorded videos they watch.
“These tracking technologies capture the PII of Defendant’s subscribers relating to specific videos that the subscribers have viewed and disclose such PII to the third-party developers, all without the subscribers’ informed, written consent,” the Redfin class action says.
Mata seeks to represent a nationwide class and California subclass of consumers who have a Redfin account and who requested or viewed a guided video tour on or through Redfin during the applicable limitations period.
Redfin violated Video Privacy Protection Act, class action claims
Mata claims Redfin violated the Video Privacy Protection Act (VPPA) and the California Invasion of Privacy Act.
“In direct contravention of the protections afforded by the VPPA, Defendant discloses to third-party companies its consumers’ PII without first obtaining their written consent,” the Redfin class action says.
The plaintiff demands a jury trial and requests declaratory and injunctive relief and an award of statutory and punitive damages for himself and all class members.
A consumer filed a similar class action lawsuit against Kia America, Kia Corp. and LexisNexis Risk Solutions earlier this year over claims Kia collected driver data without full consent and shared said data with LexisNexis, who in turn allegedly sold the data to insurance companies, causing the drivers’ insurance rates to increase.
