Mosaic Sales Solutions agreed to pay $148,000 to resolve class action lawsuit claims it failed to reimburse brand ambassadors for business expenses.

The settlement benefits individuals who worked as brand ambassadors for Mosaic Sales Solutions in California between Aug. 27, 2015, and June 30, 2021. Around 3,100 individuals are included under this class definition. 

Mosaic Sales Solutions is a marketing agency that offers a number of services including brand design, commerce support, business strategies, social media marketing and more. Brand ambassadors for Mosaic provide information on a range of products at retail locations to drive sales.

According to a class action lawsuit against Mosaic sales, the marketing agency fails to reimburse brand ambassadors for business expenses. Plaintiffs in the case say that brand ambassadors should be reimbursed for expenses such as cellphone costs, other communication expenses, mileage costs and more.

By failing to reimburse brand ambassadors for business expenses, Mosaic Sales allegedly violated California labor law. Under the state’s laws, employers are required to reimburse employees for expenses or losses incurred “in direct consequence” of their duties. 

The Mosaic Sales Solutions class action lawsuit sought compensation for these alleged violations.

Mosaic Sales Solutions hasn’t admitted any wrongdoing but agreed to a $148,000 class action settlement to resolve these allegations.

Under the terms of the settlement, class members can receive a cash payment. 

According to the settlement website, each class member is projected to receive around $20. Exact payments will vary depending on the number of class members who participate in the settlement and the net settlement fund total. The net settlement fund is estimated to be $60,000, based on projected costs for the settlement administrator, attorneys fees, litigation costs and service awards to plaintiffs.

If any checks are not cashed within 180 days, the remaining funds will be donated to Bet Tzedek Legal Services’ Employee Rights Project.

The deadline for exclusion and objection is Dec. 12, 2022. 

The final approval hearing for the Mosaic Sales Solutions settlement is scheduled for Jan. 30, 2023.

No claim form is required to benefit from the settlement. Class members who do not exclude themselves will automatically receive their share of the settlement fund.

    They did the same thing to their brand ambassadors in BC Canada too. They promised gas and mileage expenses but I never got any and I was with them for a couple of years on and off, as BAs often work seasonally. Later on, pretty much a year ago today, when covid started letting up, I began working for the company again as a merchandise specialist($4 an hour pay cut with 4 times more responsibilities) and their mileage was again promised but not paid. They often used the excuse that the app they tracked reps with, was “down” and it always took an extra hour or so just to fill out your time in the app and still not paid for it.
