Highmark Health Options, which offers insurance and other services, agreed to pay $1.85 million as part of a settlement to resolve a class action lawsuit claiming it contacted consumers with unsolicited, automated telemarketing calls.

The settlement benefits consumers who received pre-recorded or artificial voice calls from Highmark Health Options between Nov. 30, 2016, and Dec. 13, 2022.

The telemarketing class action lawsuit accuses Highmark Health of violating the federal Telephone Consumer Protection Act (TCPA) by placing unsolicited telemarketing calls to consumers. The law requires businesses to obtain consent before contacting consumers with telemarketing communications through call, text or fax.

Highmark Health Options is a health organization offering health insurance, healthcare delivery, health management and other solutions.

Highmark Health Options hasn’t admitted any wrongdoing but agreed to a $1.85 million class action lawsuit settlement to resolve these claims.

Under the terms of the Highmark Health Options lawsuit settlement, class members can receive a cash payment based on the number of calls they received. Each call will be eligible for an equal share of the net settlement fund, with class members receiving a proportional share of the net settlement fund based on the number of calls they received from Highmark Health Options. Exact payments will vary.

For example, if the net settlement fund is $1 million and 20,000 eligible calls are claimed by class members, each call would result in a payment of $50. In this situation, a class member who received 20 eligible calls would receive a cash payment of $1,000. 

The deadline for exclusion and objection is March 10, 2023.

The final approval hearing for the Highmark Health Options class action lawsuit settlement is scheduled for May 2, 2023.

In order to receive a settlement payment, class members must submit a valid claim form by March 27, 2023.

      How do I know if I am a Highmark health options Member? I do have highmark and I believe I did receive a phone call. How can I find out for sure how many calls I got, is there any way that you guys can check? Sincerely, Amy Ericksen.
