UnitedHealthcare failed to safeguard the personally identifiable information (PII) and private health information (PHI) of its patients from being compromised during a May data breach of the MOVEit file transfer software

Plaintiff Kelly Abramowitz claims UnitedHealthcare was entrusted with private information in its capacity as a health insurance company, but failed “to take precautions designed to keep that information secure.” 

Abramowitz argues UnitedHealthcare also delayed notifying its patients about the data breach, and ultimately did not follow through with its promises and representations to them that it would keep safe and secure any PII or PHI it collected. 

“Defendant owes a duty to Plaintiff and Class members to maintain adequate security measures to safeguard the PII and PHI it requested and was entrusted with,” the UnitedHealthcare class action states.

Abramowitz wants to represent a nationwide class of individuals whose personal information was compromised during the UnitedHealthcare data breach that the company publicly disclosed on or around July 27, 2023. 

Patients suffered ‘irreparable harm’ from UnitedHealthcare data breach, class action says

Abramowitz argues that, due to the sensitive nature of the information exposed during the data breach, impacted individuals have suffered “irreparable harm.” 

“Plaintiff and Class members have lost the ability to control their private information and are subject to an increased risk of identity theft,” the UnitedHealthcare class action states. 

Abramowitz claims UnitedHealthcare is guilty of unjust enrichment, breach of implied contract, negligence, and negligence per se. 

The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of statutory damages for herself and all class members. 

A separate class action lawsuit was filed against UnitedHealthcare last month by a consumer arguing the company violates the law by allegedly placing pre-recorded calls without consent.

    Include Us! America finds ways obtain Our personal Data, sells it through make “Millions $ of it, over & over again)! The Attorneys gets pay d 1st millions $’s! And the Healthcare Providers (in Medical Industry Paid Out 2nd from $1000’s to $100,000’s dollars)! Then, they divide just under $25 to under to $5 to The injured Patients (when these internal/outside culprits can use Our Personal Data any time from 2023 to LIFE! Our personal Data in their Data banks gets stolen probably from 2000 to present! Whether U canceled UHC coverage or still has this coverage! Why has everything in America from origin to present continues to get more & more corrupted? (Greed)!

    The class action will land you at best $20. Meanwhile your info gets further shared with the law firm and class administrators putting it at further risk.

    How is that going to help?

    The money would be better spent jailing the e ecutives.

    Please contact me because I am missed informed about this.. I was affected by the data breach and the only thing I was told was that I could have my credit monitored for a period of 2 years.. I didn’t accept the offer just in case a class action was to be filled..
