Data breach class action lawsuits, settlements overview:ย

Multiple class action lawsuits have recently been filed against companies due to data breach incidents.ย 

The class action lawsuits argue that companies, including Intuit, Ticketmaster, Live Nation, AT&T and several others failed to adequately safeguard and secure consumersโ€™ data in such a way that would have prevented the data breaches.ย 

A number of class action settlements involving data breaches have also recently been agreed upon, including by Group 1001, MCG Health, Carvin Software, U-Haul, Nissan, Nationwide Vision, CorrectCare and Nevada Restaurant Services.ย 

Intuit failed to adequately safeguard customer data, class action claims

A consumer filed a class action lawsuit against Intuit Inc. at the start of the month over claims the company failed to adequately safeguard customer data during a data breach disclosed in March.ย 

The class action lawsuit argues that Intuit, which owns TurboTax, Credit Karma, Quickbooks, and Mailchimp, failed to maintain reasonable security safeguards and adequately train its employees about cybersecurity.ย 

โ€œ(Intuit) had no effective means to prevent, detect, stop or mitigate breaches of its systemsโ€”thereby allowing cybercriminals unrestricted access to its current and former customersโ€™ PII,โ€ the Intuit class action says.ย 

Ticketmaster failed to safeguard personally identifiable information of customers properly, class action saysย 

A trio of consumers filed a class action lawsuit against Ticketmaster and Live Nation in July over claims they failed to properly safeguard and secure the personally identifiable info of more than 500 million consumers during a recent data breach.ย 

The class action lawsuit argues Ticketmaster and Live Nation failed to implement โ€œadequate and reasonable cyber-security procedures and protocolsโ€ that would have prevented the incident.ย 

โ€œDefendants disregarded the rights of Plaintiffs and Class Members by, among other things, intentionally, willfully, recklessly, or negligently failing to take adequate and reasonable measures to ensure its data systems were protected against unauthorized intrusions,โ€ the Ticketmaster class action says.

AT&T failed to safeguard customersโ€™ sensitive data, class action claims

A trio of consumers filed a class action lawsuit against AT&T earlier this month over claims the company failed to safeguard its customersโ€™ sensitive data.ย 

The class action lawsuit argues that AT&Tโ€™s alleged inability to safeguard the data properly caused almost 110 million of its customersโ€™ calls and text information to be compromised in a data breach.ย ย 

โ€œPlaintiff and other data breach victims provided their (personally identifiable information) to AT&T with the reasonable expectations and mutual understanding that AT&T would comply with its obligations to keep such information confidential and secure from unauthorized access,โ€ the AT&T class action says.ย 

Number of class action lawsuits recently filed over data breach incidents

A number of other class action lawsuits have recently been filed in the wake of data breach incidents involving Evolve Bank, CDK Global, Advance Auto Parts, Truist and Panera Bread.ย 

The companies are similarly accused of failing to prevent data breaches by not having adequate security safeguards in place, among other things.ย 

โ€œPlaintiff and class members now face a lifetime risk of identity theft, which is heightened here by the loss of Social Security numbers-the gold standard for identity thieves,โ€ the Evolve Bank data breach class action said.

CDK Global, meanwhile, is accused of failing to safeguard personally identifiable information that was stored within the companyโ€™s network.ย 

โ€œDefendant could have prevented the Data Breachโ€ฆ by properly securing and encrypting and/or more securely encrypting its servers,โ€ the CDK class action says.

Advance Auto Parts, Truist and Panera Bread were also accused of allowing the private info of their customers to fall into the hands of bad actors due to poor cybersecurity practices.

Other data breach-related incidents and/or class action lawsuits have recently involved Rite Aid, PruittHealth, a number of auto dealerships, TeamViewer, Twilio, Disney and Trello.ย
