The class is made up of 8,884 individuals who have been identified by Zuckerberg San Francisco General Hospital and Trauma Center as a patient whose medical records were kept by Dr. Shirley Stiver.
The San Francisco hospital medical data privacy class action lawsuit was filed against the city and county of San Francisco, the regents of the University of California and Dr. Stiver. The plaintiff alleges the highly private medical information of more than 8,800 patients was disclosed without their written authorization.
The highly private personal information includes HIV diagnoses, radiologic films, consultation notes, surgical notes and other information, the medical data privacy class action lawsuit alleges.
This disclosure of patients’ highly private medical information allegedly violated the Confidential Medical Information Act and California Health & Safety Code 120980.
Zuckerberg San Francisco General Hospital and Trauma Center is the largest primary-care facility in the city, according to its website.
Stiver is a neurosurgeon with more than 33 years of experience in medicine, according to Healthgrades.
The defendants have not admitted wrongdoing but agreed to settle the medical data privacy class action lawsuit to avoid the risk and expense of trial.
Eligible class members who filed a timely and valid claim form in the San Francisco medical data privacy settlement may be entitled to receive a payment of up to $599, although the actual amount each claimant will receive depends on the total number of claims filed. Payments will be distributed on a pro rata basis.
Class members who wish to exclude themselves from or object to the medical data privacy settlement must do so no later than Aug. 2, 2022.
A final approval hearing will be held Sept. 29, 2022.
Class members must submit a claim form by Aug. 30, 2022, to be eligible for a payment from the San Francisco medical data privacy settlement.
