Mulkay Cardiology agreed to a class action lawsuit settlement to resolve claims that it failed to prevent a 2023 data breach.

The Mulkay Cardiology Consultants settlement benefits individuals who received a notice that their information was compromised in a Mulkay Cardiology data breach Sept. 1-5, 2023.

According to the data breach class action lawsuit, Mulkay Cardiology failed to implement reasonable cybersecurity measures that could have prevented a data breach. The breach allegedly compromised sensitive patient information, such as Social Security numbers and health insurance data.

Mulkay Cardiology Consultants is a cardiology practice with locations in New Jersey.

Mulkay Cardiology hasn’t admitted any wrongdoing but agreed to pay an undisclosed sum to resolve the data breach class action lawsuit.

Under the terms of the Mulkay Cardiology Consultants settlement, class members can receive reimbursement for data breach-related expenses. This includes unreimbursed bank fees, communication charges, travel expenses, credit-related costs and up to three hours of lost time at a rate of $25 per hour. The settlement caps these payments at $500 per class member for ordinary losses. Class members who experienced extraordinary losses as a result of the data breach can receive up to $5,000 in additional compensation for these expenses.

In lieu of reimbursement, class members can choose to receive a one-time payment of $48.

All class members are eligible for two years of free credit-monitoring services. These services include three-bureau monitoring, dark web scanning, public record monitoring, medical identity monitoring, identity theft insurance and more.

Mulkay Cardiology also agreed to improve its data security measures as part of the settlement. 

The deadline for exclusion and objection is Jan. 8, 2025.

The opt-out and objection deadline was Jan. 8, 2025.

The final approval hearing for the Mulkay Cardiology data breach settlement is scheduled for April 11, 2025.

To receive settlement benefits, class members must submit a valid claim form by Feb. 22, 2025.

Individuals who were impacted by the Mulkay Cardiology Consultants data incident, including all who received a notice of the data incident that occurred Sept. 1-5, 2023
