Mortgage corporation Mr. Cooper failed to protect the personally identifiable information (PII) of its customers during a data breach discovered by the company at the end of last month, a new class action lawsuit alleges.ย
Plaintiff Nancy Randall claims Mr. Cooper was obligated by industry standards to safeguard any information in its systems containing PII, yet allegedly failed to do so during a data breach event it purported to discover on Oct. 31.ย
Randall argues Mr. Cooper also failed to provide timely, accurate and adequate notice to inform herself and other class members that their PII allegedly had been compromised during the data breach.ย
โThe security incident was wide-reaching, impacting a number of the Defendantโs computer systems and compromising the PII of millions of people,โ the Mr. Cooper class action states.ย
Randall wants to represent a nationwide class and Washington subclass of individuals who had their PII maintained by Mr. Cooper and were sent a notice regarding the data breach.ย
Mr. Cooper failed to implement, follow โbasic security procedures,โ class action says
Randall argues her and other class members PII is now โin the hands of criminalsโ due to an alleged failure by Mr. Cooper to โimplement and follow basic security procedures.โย
โConsequently, Plaintiff and Class Members have had to spend, and will continue to spend, significant time and money in the future to protect themselves due to the Defendantโs failures,โ the Mr. Cooper class action states.ย
Randall claims Mr. Cooper is guilty of unjust enrichment, breach of implied contract, negligence, negligence per se and is in violation of the Washington Consumer Protection Act.ย
The plaintiff is demanding a jury trial and requesting declaratory and injunctive relief along with an award of compensatory, statutory, treble and/or punitive damages for herself and all class members.ย
In March, Nationstar โ which is now known as Mr. Cooper โ agreed to pay $5 million to end claims it sent incorrect automated clearing house entries to the bank accounts of mortgage borrowers in April 2021.ย

Got the letter on jan 4th. How are we suppose to find out if our info was taken and it says it protects on a single bureau not all.

I received a letter which upsets me because they so matter-of-factly told me I can sign up for a monitoring service to basically make sure no one is stealing my identity. It doesnโt tell me if my information was actually taken or not. How do they not know??
Yep! Got the letter today too. And I actually had issues with our bank account compromised a few weeks ago. I wonder if this was a result of that breach.
