A Pennsylvania man is suing software company Intelligent Business Solutions alleging the company was negligent when it allowed a data breach that exposed more than 11,000 people’s names, social security numbers and private medical information.
Plaintiff Daniel Panighetti filed the class action lawsuit against Intelligent Business Solutions Inc. (IBS) on March 7 in a North Carolina federal court alleging violations of state and federal laws.
IBS is a corporation that sells “process improvement solutions” to healthcare entities, the lawsuit states.
As part of its business, it obtains and maintains a “litany” of highly sensitive personal identifiable information (PII) and protected health information (PHI) about its clients’ current and former patients, the lawsuit states.
“But Defendant lost control over that data when cybercriminals infiltrated its insufficiently protected computer systems in a data breach,” Panighetti alleges.
IBS waited 87 days to advise people affected by breach, lawsuit states
An “unauthorized actor” entered the IBS systems between Nov. 10, 2022, and Nov. 15, 2022, the lawsuit alleges.
Because of the breach, Social Security numbers, dates of birth, health insurance information, medical treatment information and medical procedure information of at least 11,595 people were exposed, the lawsuit states.
“And yet, Defendant waited 87 days before it began notifying the class,” Panighetti states.
“The exposure of one’s PII/PHI to cybercriminals is a bell that cannot be unrung,” he says.
“Before this data breach, Plaintiff’s and the Class’s private information was exactly that—private. Not anymore. Now, their private information is forever exposed and unsecure.”
Panighetti seeks to represent any in the United States whose PII and PHI was compromised in the breach.
He’s suing for negligence, breach of implied contract and intrusion upon seclusion and unjust enrichment and seeks certification of the class action, damages, fees, costs and a jury trial.
