HealthEquity data breach class action lawsuit overview:ย 

  • Who: Colin Booth filed a class action lawsuit against HealthEquity Inc.ย 
  • Why: Booth claims HealthEquity failed to properly safeguard and secure the personally identifiable information of its customers during a data breach that happened in or about last month.ย 
  • Where: The HealthEquity class action lawsuit was filed in Utah federal court.ย 

A new class action lawsuit claims HealthEquity failed to properly safeguard and secure the personally identifiable information (PII) of its customers during a data breach around last month.ย 

Plaintiff Colin Booth claims HealthEquity failed to protect the customer data while having a legal and equitable duty to safeguard it from unauthorized access and intrusion.ย 

โ€œDefendant failed to adequately protect Plaintiffโ€™s and Class Members PIIโ€“โ€“and failed to even encrypt or redact this highly sensitive information,โ€ the HealthEquity class action says.ย 

Booth wants to represent a nationwide class of individuals whose PII was accessed or acquired by an unauthorized party as a result of the HealthEquity data breach in or about July 2024.ย 

HealthEquity customers now at ongoing risk of identity theft, class action claims

Information exposed in the data breach included HealthEquity customersโ€™ names, addresses, phone numbers, employee IDs, employers, dependent information, payment card information and Social Security numbers, according to the HealthEquity class action.ย 

Booth argues hackers targeted this information to use it to exploit and steal the identities of the HealthEquity customers, who he claims are now at a present and continued risk of identity theft and fraud and will remain so โ€œfor their respective lifetimes.โ€ย 

โ€œThis unencrypted, unredacted PII was compromised due to Defendantโ€™s negligent and/or careless acts and omissions and its utter failure to protect customersโ€™ sensitive data,โ€ the HealthEquity class action says.ย 

Booth claims HealthEquity is guilty of negligence and negligence per se, breach of contract and unjust enrichment. He demands a jury trial and requests declaratory and injunctive relief and an award of actual, statutory, nominal, and consequential damages for himself and all class members.ย 

HealthEquity, in a notice filed with the Maine attorney generalโ€™s office, said the data breach affected 4.3 million customers and attributed the incident โ€” which the company says occurred in March and was discovered in June โ€” to a vendorโ€™s user accounts becoming compromised.ย

    I received the letter at my residence on September 8, 2024
    I am alarmed by the unauthorized access to my PII for the following reasons:

    Negligence: HealthEquity may have been negligent in its security practices, failing to take reasonable steps to protect my data.
    Breach of contract: My contract with HealthEquity may have included terms regarding data security that were violated.
    Violation of consumer protection laws: The breach may have violated state or federal consumer protection laws.

    The date on my letter is August 9, 2024 but I didnโ€™t receive my letter until September 4 2024. The security breach took place in March 2024. Why am I just being notified about my personal and my dependents information being hacked?

    My personal information has been stolen due to a unsecured data breach. One of your vendors how many vendors do you have thatโ€™s unsecured? Wageworks and Further Operations LLC is part of this unsecured network hold them accountable. Stored in an unstructured data repository outside our core system? Who gave permission to store my personal information to an outside core system where is my signature for allowing this? My first name, last name, address, telephone number, employee ID number, employer, ss#, my kids information thatโ€™s a huge risk my kids are minors thatโ€™s illegal. Once again who gave permission to store my personal and my dependents information in an unstructured unsecured data repository core system? Please add me and my dependents to this Top Class action lawsuit.
