DuPage Medical Group agreed to a $3 million settlement to resolve class action lawsuit claims it failed to protect patient information in a 2021 data breach.

The settlement benefits individuals whose personal information was compromised in the DuPage Medical Group data breach between July 12 and 13, 2021.

DuPage Medical Group is Illinois’ largest independent physician group. In August 2021, DuPage announced it had been the target of a cyberattack July 12, 2021. The attack reportedly caused a network outage and may have compromised the information of around 600,000 patients. Data impacted by the breach includes names, birth dates, contact information, health information and, for some patients, Social Security numbers. 

Patients affected by the breach took legal action against DuPage Medical, accusing the group of negligence that resulted in the data breach. Plaintiffs in the case argue DuPage should have implemented cybersecurity measures and monitored its systems in order to prevent the data breach. Patients such as the plaintiffs allegedly face a heightened risk of fraud and identity theft due to the data breach.

DuPage hasn’t admitted any wrongdoing but agreed to pay $3 million to resolve these allegations.

Under the terms of the settlement, class members can receive a payment of up to $150 for ordinary expense reimbursement, up to $5,000 for extraordinary expense reimbursement or an alternative payment of $50.

Ordinary expenses covered by the settlement include credit report costs, credit monitoring expenses, bank fees, communication charges, travel expenses and up to three and a half hours of lost time at a rate of $25 per hour. 

Extraordinary expenses covered by the settlement include unreimbursed fraudulent charges and damages from identity theft. Class members who did not experience ordinary or extraordinary out-of-pocket expenses as a result of the data breach can recover an alternate payment of $50.

All class members can receive two years of credit monitoring services through IDX. This protection includes real time credit file monitoring, $1 million in identity-theft insurance and access to fraud-resolution services.

In addition to providing cash benefits, DuPage has agreed to make changes to improve its data security. Some changes have already been made while others will be made over the next two years.

The deadline for exclusion and objection is Oct. 30, 2022. 

The final approval hearing is scheduled for Nov. 14, 2022. 

In order to receive benefits from the DuPage Medical Group data breach lawsuit settlement, class members must submit a valid claim form by Nov. 29, 2022.
