David’s Bridal data breach class action overview: 

  • Who: A former David’s Bridal employee, Mariah Martinez, is suing the company.

David’s Bridal has been hit with a class action lawsuit after a data breach compromised the sensitive personal information of its current and former employees earlier this year.

Plaintiff Mariah Martinez, an employee of the well-known bridal retailer, filed the class action complaint against David’s Bridal LLC on Oct. 4 in a Pennsylvania federal court, alleging violations of state and federal consumer laws.

Martinez claims David’s Bridal failed to adequately safeguard employee data, including Social Security numbers and other personally identifiable information.

David’s Bridal class action alleges sensitive information was left unprotected

David’s Bridal collects and retains personal information from employees to manage employment-related matters and benefits, Martinez says. She alleges that the company kept this data unencrypted, making it extremely vulnerable to unauthorized access. 

According to the lawsuit, hackers accessed and copied employee data from David’s Bridal systems in January. Despite this, the company only notified affected individuals in September, she says.

The lawsuit argues that David’s Bridal failed to implement reasonable security protocols, such as encryption, to protect employees’ sensitive information. Plus, the delay in notifying victims of the breach left employees unaware of the potential risks to their identities. 

As a result, Martinez is looking to represent anyone who was impacted by the David’s Bridal data breach. She is suing for negligence and violations of federal and state privacy laws and alleges the company failed to follow industry-standard practices for data security. 

Martinez is seeking certification of the class action, fees, costs and compensation for damages, including the cost of credit monitoring and the time and effort required to mitigate the breach’s consequences. The complaint also calls for injunctive relief, demanding that David’s Bridal improve its data security practices to prevent future breaches. 

In September, Teachers Insurance and Annuity Association was hit with a class action lawsuit alleging the company and its life insurance subsidiary failed to adequately safeguard client data, leaving it vulnerable to a 2023 data breach.
