Zappos has agreed to provide 10 percent discounts to the 24 million consumers affected by a 2012 data breach.

The settlement benefits consumers who had an online Zappos.com account before Jan. 15, 2012 and whose email address was in Zappos records at the time.

Plaintiffs in the Zappos class action claimed that the shoe retailer failed to protect consumer information. This lapse in cybersecurity resulted in hackers accessing Zappos records in 2012, allegedly compromising the information of 24 million customers with accounts.

Zappos attempted to compel arbitration in the case but was denied in October 2012. The company later tried to dismiss the claims but the motion was denied. However, a federal judge later reversed the decision. Litigation continued when the plaintiffs appealed the decision in the Ninth Circuit, resulting in the claims’ revival.

After years of back and forth, Zappos.com Inc. agreed to settle the claims against them in September 2019. Both Zappos and the plaintiffs agreed to the settlement after weighing the risks and costs of continuing to fiercely litigate the claims in court.

“The settlement, in contrast, delivers a real, timely, and substantial remedy to settlement class members without the risks and delay inherent in further litigation,” the plaintiffs argued in their settlement motion.

The Zappos class action settlement will provide a 10 percent discount code to eligible consumers. These codes will be automatically emailed to eligible Class Members. No Claim Form is required.

In order to object to the settlement or opt out of the deal, Class Members need to file their requests by Nov. 29, 2019. The final approval hearing for the settlement is scheduled for Dec. 20, 2019.

Who’s Eligible

Consumers who had an online Zappos.com account before Jan. 15, 2012 and whose email address was in Zappos records at the time.

A 10 percent discount on a Zappos.com purchase.

A Claim Form is not available on the settlement website. If you are a Class Member, you should automatically receive the 10 percent discount via email.     This is a joke! 10% for your personal data? That doesn’t even cover the markup for these retailers. This likely just gives them additional opportunity to make more money…

    Don’t add me, this settlement is crap!! Worse than Equifax.. why should these companies protect customers information when they get nothing but a slap on the hand. These settlements should be large enough for these companies to sit up and take notice and realize it is in their best interest to protect customers info. In the meantime our email and phone numbers and credit cards are being hijacked by hackers and making our lives miserable and you want to give us a miserly little 10 percent discount on your products! Oh Hell No!!!!
