Eddie Bauer has agreed to pay up to $2.8 million to resolve claims that they mishandled a 2016 data breach.

The settlement will benefit financial institutions that issued one or more payment cards identified as “at risk” due to the Eddie Bauer cyber-attack announced in 2016.

In January 2016, a cyber-attack reportedly resulted in compromised consumer information from 350 Eddie Bauer stores in the U.S. and Canada.

In March 2017, Veridian Credit Union filed a class action lawsuit on behalf of themselves and their customers. Veridian argued that Eddie Bauer violated the Washington Consumer Protection Act and other state laws by allowing consumer information to be compromised.

“The Eddie Bauer Data Breach was directly caused by Defendant’s failure to adequately secure its data networks,” Veridian argued in their Eddie Bauer data breach class action.

The credit union aimed to recover compensation for payment card reissuance, the amount spent to cover fraudulent charges, and other costs allegedly resulting from the Eddie Bauer data breach.

In April 2019, Eddie Bauer agreed to pay between $1 million and $2.8 million to resolve Veridian’s class action claims. The company will also spent $5 million to buff up its security protocols and an additional $2 million to cover administrative costs, service awards, attorneys’ fees, and other expenses.

The settlement will provide eligible financial institution with $2 for each issued card that was affected by the Eddie Bauer data breach.

Depending on the number of valid claims filed, this amount per card may increase. In order to receive payment from the settlement, Class Members need to submit a valid claim by Oct. 10, 2019.

The deadline for exclusion is Sept. 10, 2019. The deadline for objection is Oct. 4, 2019. The final approval hearing for the settlement is scheduled for Oct. 25, 2019.

Financial institutions that issued one or more payment cards identified as “at risk” due to the Eddie Bauer cyber-attack announced in 2016.

Potential Award

$2 for each eligible payment card issued.
