Arby’s Data Breach Class Action Settlement

Plaintiffs have secured a $2 million settlement in a class action lawsuit over an alleged Arby’s data breach.

Those who can participate in the settlement include consumers who made debit or credit card purchases at certain Arby’s restaurants in the following states: Alabama, Connecticut, Florida, Georgia, Illinois, Indiana, Kentucky, Maryland, Michigan, Minnesota, Missouri, New Jersey, New York, North Carolina, Ohio, Pennsylvania, South Carolina, Tennessee, Utah, Virginia, West Virginia, Wisconsin, Wyoming.

Specific restaurants were affected by the alleged Arby’s data breach and during different times – approximately Oct. 8, 2016 and Jan. 12, 2017. Those who want to make a claim under this class action settlement should check this list to see if they qualify.

Lead plaintiffs alleged in a class action lawsuit that an Arby’s data breach had exposed the debit and credit card information of consumers. The plaintiffs say that the breach began in 2016 after hackers got access to Arby’s sale system.

The Arby’s class action lawsuit claimed that Arby’s both failed to secure their sale system and also failed to notify affected consumers in a timely fashion — exposing them to potential identity theft and fraud.

The plaintiffs themselves said they suffered thousands in unauthorized charges due to the breach.

According to the Arby’s class action lawsuit, 355,000 credit and debit cards were accessed in the Arby’s data breach.

Under the terms of the Arby’s data breach class action settlement, Arby’s has agreed to pay $2 million to Class Members, as well as to cover attorneys’ fees and costs and awards for the lead plaintiffs.

Class Members are eligible to receive up to $5,000 in reimbursements for documented expenses related to the Arby’s data breach, as well as reimbursement for the time they spent dealing with matters related to the breach.

Additionally, Class Members can claim free identity theft protection service through the Arby’s class action settlement.

Class Members must submit a Claim Form that indicates the Arby’s locations where their debit or credit card information may have been exposed, along with documentation of any unreimbursed expenses.

To object to the Arby’s settlement or ask to be excluded from its terms, Class Members must do so in writing by March 29, 2019.

Who’s Eligible

Class Members include those who made credit or debit card purchases at certain Arby’s locations during particular time frames, approximately Oct. 8, 2016 and Jan. 12, 2017. A list of locations and time frames is available.

Potential Award

Up to $5,000 and identity theft protection.

Class Members can claim up to $5,000 in unreimbursed expenses related to the alleged Arby’s data breach as well as for their time spent dealing with issues related to the data breach. Additionally, Class Members will receive free identity theft protection.

Proof of Purchase

Claim Form and documentation of unreimbursed expenses related to the data breach, including identity theft or fraud, costs of taking out a loan, ATM withdrawal fees due to restricted access to debit or credit cards, preventative costs, including purchasing credit monitoring or credit reports, and bank fees related to overdrafts, returned checks, or other fees related to the data breach.
