23andMe has agreed to a class action lawsuit settlement to resolve claims it failed to protect consumers from a 2023 data breach.

The 23andMe data breach class action settlement benefits individuals who received a data breach notification from 23andMe informing them their personal information was compromised in October 2023.

Plaintiffs in the class action lawsuit claimed that 23andMe failed to protect their information in a data breach that reportedly compromised sensitive information, such as genetic data, health reports and raw data.

In September 2024, 23andMe agreed to a separate $30 million settlement that primarily benefited residents of Alaska, California, Oregon and Illinois, which have genetic privacy laws that provide for statutory damages.

23andMe is a genetic testing company that provides consumers with information about their ancestry and health risks based on their DNA. On March 23, 2025, 23andMe announced that it had filed for voluntary Chapter 11 restructuring in the U.S. Bankruptcy Court for the Eastern District of Missouri, but it continues to operate as normal.

23andMe has not admitted any wrongdoing but agreed to pay a settlement to resolve the data breach class action allegations.

Under the terms of the 23andMe data breach class action settlement, class members can receive a cash payment.

Class members who can provide documentation of data breach-related expenses, such as credit monitoring, identity theft expenses, bank fees and more, can receive up to $1,500. Class members who do not have documentation can receive up to $500 for undocumented expenses.

There are no specific dates for objection and exclusion nor final hearings.

To receive settlement benefits, class members must submit a claim by July 14, 2025.

Who’s Eligible

23andMe customers between May 1 and Oct. 1, 2023, who received a data breach notification from 23andMe informing them that their personal information was compromised in October 2023.

Potential Award

Up to $500 for undocumented expenses and up to $1,500 for documented expenses.

Proof of Purchase

Documentation of damages, such as credit card or bank statements, invoices or receipts.
