A $1.6 million settlement resolves claims that Hilb Group failed to prevent a data breach that may have exposed sensitive customer information during a data breach that occurred between Dec. 1, 2022 and Jan. 12, 2023.
The Hilb Group settlement benefits individuals whose personal information was accessed or potentially accessed during the Hilb Group data breach, as well as those whom the company mailed a data breach notification.
The class action lawsuit alleges an unauthorized third party may have gained access to certain Hilb Group files containing sensitive customer information, including full names, addresses, Social Security numbers, financial account data, identification and passport information, medical records and health insurance data. Plaintiffs in the case claim Hilb Group should have implemented reasonable cybersecurity measures to prevent the data breach.
Hilb Group Operating Co. is an insurance agency that offers property and casualty, employee benefits, retirement and specialty insurance products.
The Hilb Group denies any wrongdoing but agreed to pay $1.6 million to resolve the data breach class action lawsuit.
Under the terms of the Hilb Group settlement, class members can receive up to $5,000 in reimbursement for documented out-of-pocket losses resulting from the security incident. Reimbursement is available for a range of damages, such as costs incurred from credit monitoring services, late fees and unauthorized charges on payment cards.
Class members may also be eligible to receive a pro rata cash payment of remaining settlement funds. These payments are estimated to be around $75 but may be adjusted based on the number of claims filed.
The deadline to opt out or object to the settlement was Nov. 13, 2024.
The final approval hearing is set for Feb. 3, 2025.
The claim form deadline is Dec. 13, 2024.
