A $1.575 million Behavioral Health Group settlement resolves claims that the health care provider failed to protect patients from a 2021 data breach.

The settlement benefits individuals who received a data breach notification from Behavioral Health Group regarding a December 2021 cyberattack that may have compromised their personal information. 

According to the data breach class action lawsuit, Behavioral Health Group failed to protect patient data from a December 2021 breach of its systems. Patients in the case claim BHG could have prevented or mitigated the cyberattack by implementing reasonable cybersecurity measures.

Behavioral Health Group is an outpatient opioid addiction treatment center.

Behavioral Health Group hasn’t admitted any wrongdoing but agreed to pay $1.575 million to resolve the data breach class action lawsuit.

Under the terms of the Behavioral Health Group settlement, class members can receive up to $200 in reimbursement for ordinary data breach-related expenses, such as bank fees, credit expenses, travel costs, communication charges and up to eight hours of lost time compensated at a rate of $25 per hour. Class members who experienced extraordinary data breach losses stemming from fraud or identity theft can receive up to $5,000 in additional reimbursement for these damages.

Class members who claim unreimbursed losses are also eligible for two years of free credit monitoring and identity theft protection services. These services include three-bureau monitoring and $1 million in identity theft insurance.

Class members who do not have documented losses or who do not wish to claim them in the settlement can instead claim an alternative cash payment. These payments will vary depending on the number of claims filed and other factors but are estimated to be around $150. Alternative cash payments are capped at $250.

The deadline for exclusion and objection was Sept. 23, 2024.The final approval hearing for the settlement is scheduled for Oct. 29, 2024.

To receive Behavioral Health Group settlement benefits, class members must submit a valid claim form by Oct. 23, 2024.
