Parcel Pending has agreed to pay $400,000 to resolve claims that they recorded consumer calls without consent.

The settlement will benefit individuals who received a phone call from Parcel Pending between Feb. 1, 2018 and Oct. 3, 2018.

Plaintiff Jayson Swigart filed his call recording lawsuit against Parcel Pending in September 2018. Swigart claimed that Parcel Pending violated the California Invasion of Privacy Act by recording consumer calls without consent.

The California Invasion of Privacy Act is one of several state laws that protect Californians from violations of privacy through telephone calls. Before the law was passed in 1967, call recording was allowed if one party consented. The new privacy law is a “two party” law – meaning that all parties in a communication must consent to call recording for it to be legal.

Swigart was allegedly called by Parcel Pending multiple times in July 2018. During his conversations with the company, Swigart says he was not informed that his calls were being recorded despite the sensitive nature of the calls.

“Plaintiff was shocked to discover that such a confidential communication was being recorded by Defendant without Plaintiff’s knowledge or consent,” the call recording class action lawsuit claimed. “Plaintiff found Defendant’s clandestine recording to be highly offensive due to the delicacy of the topics discussed during said conversations.”

Parcel Pending has agreed to settle the case but has not admitted any wrongdoing. Under the settlement, each plaintiff will be able to collect a pro rata portion of the net settlement fund.

Class counsel estimates that each claimant will receive around $71, but the true amount could be more or less depending on the number of valid claims filed.

In order to receive a payment from the settlement, Class Members need to file a valid claim by Aug. 19, 2019. Failure to do anything means that Class Members will not receive any payments and will also give up their rights to bring future lawsuits against Parcel Pending for the same issue.

The deadline for exclusion and objection is Aug. 19, 2019. The final approval hearing is scheduled for Oct. 21, 2019.

Who’s Eligible

Individuals who received a phone call from Parcel Pending Inc. between Feb. 1, 2018 and Oct. 3, 2018.

Potential Award

$71 (estimate).

Each claimant will receive a pro rata portion of the net settlement fund, so the exact payment amount could be more or less depending on the number of valid claims filed.
