Kiip Mobile App Spying Class Action Settlement

Kiip has agreed to pay $1 million to resolve class action lawsuit claims that the company used gaming apps to collect consumer data.

The settlement will benefit consumers who used an app integrated with the Kiip advertising platform from Jan. 1, 2010 to June 13, 2019.

Some of the covered apps include: Bingo Casinos, Bingo Vegas, Bubble Pop Rewards, Flick Kick Field Goal Kickoff, GameAir Blackjack, GameAir Video Poker, Hidden Object Rewards, Maze Runner, PrizeLoot, Runkeeper, Solitaire Rewards, Word Finder, Zombie Assault: Sniper, among others. Plaintiffs Christine Farag and Jessica Vasil filed their Kiip spying class action lawsuit in federal court in October 2016. The two women claimed that Kiip partnered with app maker FitnessKeeper d/b/a Runkeeper to steal personal information from consumer devices.

Although Kiip went through FitnessKeeper to harvest consumer data, the two plaintiffs did not include the company in their spyware class action. FitnessKeeper was allegedly unaware of the data collection and ended its relationship with Kiip after discovering that the company was using their partnership to spy on their customers.

The plaintiffs claimed that Kiip violated the federal wiretap law and the Illinois eavesdropping statute. Their suit also included claims of unjust enrichment.

In February 2019, the Kiip spying class action was moved from federal court to an Illinois circuit court. The settlement resolution was reached shortly after the move.

There is not an estimate of how much each Class Member will collect under the settlement. Because claimants will receive a pro rata share of the net settlement fund, payments will depend on 1) the number of claims filed and 2) the amount deducted from the settlement fund for administrative costs, service awards, court costs, and attorneys’ fees.

In order to benefit from the settlement, Class Members need to file a valid claim by Sept. 11, 2019. The deadline for exclusion is Sept. 11, 2019. The deadline for objection is Sept. 18, 2019. The final approval hearing is scheduled for Oct. 18, 2019.
