Cedar Financial has agreed to pay $800,000 to resolve claims that they illegally recorded consumer calls in California without getting consent.

The settlement will benefit all individuals who received calls on their cell phones in California from Cedar Financial between July 28, 2015 and April 19, 2018 and whose calls were recorded.

Plaintiff Stephen Chang filed his class actin lawsuit against Cedar Financial in July 2016. He claimed that his calls to and from Cedar were recorded without his consent and that other consumers were affected by the issue as well.

California has strict privacy laws that include protections against recording calls without consent. Under these laws, businesses are required to obtain the consent of all parties before recording calls. Chang accused Cedar Financial of violating these laws in his class action lawsuit.

Cedar Financial does not admit any wrongdoing by settling the California call recording class action lawsuit against them. Instead, the settlement will allow all parties to resolve the issue without the costs, risks, and hassle of continuing litigation.

Under the settlement, eligible Class Members will be able to recover cash payments if they had calls recorded without consent.

The exact payment amount will depend on the number of valid claims filed, but class counsel estimates that each Class Member’s payment will exceed $150.

In order to receive payment from the settlement, Class Members need to file a valid claim by July 24, 2019. The objection deadline is July 24, 2019. The final approval hearing is scheduled for Aug. 26, 2019.

Who’s Eligible

Individuals who received calls from Cedar Financial between July 28, 2015 and April 19, 2018 and whose calls were recorded.

Potential Award

$150 (estimate).

The exact payment amount will depend on how many Class Members submit valid claims.
