A $6.5 million class action settlement is set to resolve claims that Nationstar Mortgage violated California state law by not receiving consent to record phone conversations with consumers.

Class Members include those who received a call from Nationstar on their cell phone while in California between Oct. 23, 2014 and May 1, 2016 and who did not receive notice that the call was being recorded.

Nationstar Mortgage LLC, now known as Mr. Cooper, facilitates home loan mortgages.

Lead plaintiffs accused the mortgage company of recording their calls without permission in violation of California state law.

According to the California Nationstar Mortgage call recording class action lawsuit, cell phone customer calls were recorded without their knowledge or permission.

California affords its residents some of the most restrictive privacy protections in the nation. Under California call recording laws, both parties to a call must agree to call recording.

Generally, when calling customer service departments of major companies, this permission comes in the form of an opt out message the customer receives prior to engaging in the call, e.g.,”this call may be recorded for training purposes.” If the customer remains on the line, they are deemed to have agreed to the call recording.

The California Nationstar mortgage call recording class action lawsuit alleges that the company neglected to inform California consumers that it was recording their calls in violation of the California Invasion of Privacy Act.

Under the terms of the class action settlement, a little more than $4 million will be distributed to Class Members on a pro rata basis, meaning that each Class Member’s award will depend on the total number of valid claims filed.

Class Members will need to provide their Unique ID, found on their Notice, or the cell number called by Nationstar.

Class Members have until July 5, 2019 to object to or exclude themselves from the California Nationstar Mortgage call recording class action settlement.

Who’s Eligible

You are a Class Member if “you received an initial outbound call from [Nationstar] between October 23, 2014, and May 1, 2016, on your cellular phone while you were physically present in California and Defendant recorded the call without first informing you it would be recorded.”

To be determined. Claims will be paid on a pro rata basis.
